Within the scope of the ADR agreement, there are exemptions that regulate the total or partial NON-application of the provisions concerning the transport of dangerous goods by road, based on certain very specific criteria.

Among the exemptions provided, Chapter 1.1.3.1 defines the nature of transport for which the ADR provisions do not apply as if it were the transport of NON-dangerous goods.

Specifically, paragraph a) regulates transport by private individuals, defining the reasons for transport and the maximum quantities allowed both as container capacity and as transport units.

Paragraph c), on the other hand, regulates transport by enterprises, again defining the reasons, the methods and the maximum quantities allowed both as container capacity and as transport units.
 
As the transport is exempt from the application of the ADR, the use of approved tanks (IBC/GIR) is not required, but the obligation to use containers suitable for the transport of the goods to be handled and capable of preventing leakage and dispersion of the contents for safe transport remains. The responsibility for the safety of the transport is borne by the user (whomever transports), as is the responsibility for proving the nature of the transport and compliance with the exemption.
 
The ADR agreement establishes two types of exemption: total exemption and partial exemption. In summary:
 
Total exemption refers to Chapter 1.1.3.1 and provides for:
• Suitable packaging
• Capacity no greater than 450 litres per package and in any case within the limits of the maximum quantities specified in Chapter 1.1.3.6 (e.g. for diesel fuel, up to 900 litres per transport unit but in 2 packages of 450 litres, for gasoline the limit is still 330 litres as per Chapter 1.1.3.6)
• Only direct routes to or from the refuelling point are allowed and in any case permitted by the highway code (NO intermediate legs)
 
Partial exemption refers to Chapter 1.1.3.6 and provides for:
• Approved packaging with mandatory revision every 30 months
• Capacity limited by Chapter 1.1.3.6. (e.g. for diesel the tank capacity can be up to 1000 litres, for gasoline the limit is 330 litres)
• Any route permitted by the highway code is allowed
